Terms of Service
Last updated: September 2026 · Provider: The APES Company LLC
1. Acceptance of Terms
By accessing, registering for, or using the website, software terminal, or services provided by The APES Company LLC ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service, our Privacy Policy, and our Financial Disclaimer. If you do not agree to all of these terms, you must immediately cease all use of the platform.
2. Description of Service
The platform is an alternative data utility and subscription-based software-as-a-service (SaaS) application that provides text-optimized market aggregation, crowdsourced community share ledger verification, options risk metrics, and short-interest visualizations. The platform integrates with brokerages via API strictly for scheduled data synchronization and portfolio aggregation.
3. Intellectual Property
The platform — including its software, source code, data compilations, visualizations, documentation, and branding — and all related intellectual property rights are owned by The APES Company LLC or its licensors. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for its intended purpose. No ownership or intellectual property rights are transferred to you.
4. Payments, Billing & Merchant of Record
Our order process is conducted by our online reseller and Merchant of Record, Paddle. Paddle is the merchant for all orders: it handles payment, billing, and applicable taxes, and issues receipts on our behalf. By completing a purchase you also agree to Paddle's Buyer Terms.
Subscriptions renew automatically at the then-current price for the applicable billing period until cancelled. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid billing period. Refunds are governed by our Refund Policy.
5. "As-Is" and "As-Available" Disclaimer
THE SERVICE, SOFTWARE, DATA FEEDS, AND CROWDSOURCED METRICS ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the platform will be uninterrupted, error-free, secure, or free of harmful components, or that crowdsourced data inputs will be complete or accurate.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, TRADING LOSSES, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR DATA. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL BE STRICTLY LIMITED TO THE GREATER OF THE AMOUNT PAID BY YOU TO US IN THE PAST TWELVE (12) MONTHS OR ONE HUNDRED U.S. DOLLARS ($100.00 USD).
7. Acceptable Use Policy & Prohibitions
You agree not to use the platform to:
- Bypass, disable, or interfere with security-related features, unskippable data verification gates, or anti-adblock frameworks.
- Deploy scrapers, spiders, bots, automated scripts, or unauthorized API querying tools to extract data from the platform.
- Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying architecture of the software.
- Upload or transmit malicious code, viruses, or software designed to damage or disrupt system performance.
8. Account Suspension and Termination
We reserve the right to suspend, restrict, or terminate your account and immediate access to the platform for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in New Mexico, and you consent to the personal jurisdiction of such courts.
